Law gives military spouses flexibility in residency
New national legislation can simplify tax time for military spouses by allowing them to maintain consistent residency in one state, even as they move to be with their service members at their duty stations.
The Military Spouses Residency Relief Act, passed by Congress in November, offers military spouses the same flexibility in choosing their state residency that service members have enjoyed for decades through the Servicemembers Civil Relief Act. Tax year 2009 is the first during which military spouses can exercise this new right.
